retainer

The Client shall reserve the time and date of services by signing and returning this agreement with a non-refundable reservation retainer, as specified on the wedding quote. This retainer payment, along with this signed document, guarantees service on the designated wedding date only. Services cannot be guaranteed in the event that the date of the wedding is changed. If either the retainer payment or this signed document are not received from the Client, the Photographer has no obligation to provide services for the Client’s event.

prior to the wedding date

The Client shall provide the Photographer a complete and correct itinerary of the wedding day at least one (1) week in advance of the wedding date. Any errors or omissions in the itinerary, including typographical errors, are the sole responsibility of the Client, and the Photographer shall not be held responsible for any resulting loss or omission of services. The Client shall provide the Photographer with direct contact information (eg., cell phone number) for a minimum of three (3) wedding attendees who are knowledgeable of the wedding itinerary (This may include the wedding couple). These contacts will be responsible for being available to provide necessary details on the wedding day as needed.

on the wedding date

On the designated wedding date, the hours of service offered begin when the Photographer arrives at the first location and end when the Photographer completes breakdown at the last location. The Client agrees to provide a meal for the Photographer and assistants if the requested services consist of more than six (6) hours of coverage. If a meal is not provided, the Client agrees that the Photographer and assistants are entitled to a one hour paid meal break. The Client agrees to ensure the Photographer and assistants will be served their meal in the same timeframe as other wedding attendees in order to maximize photography coverage. If the meal is served to the Photographer while other events are occurring, the Client agrees that the Photographer shall not be responsible for photographing those events.

All hours of work outside of the quoted services will be billed as overtime, at a rate of $ 800 per hour, plus $200 per hour per assistant. The Client is responsible for ensuring that the venues, locations, and all in attendance of the wedding can be photographed, and that those photographs will be the sole property of the Photographer. Adequate time and attention should be given to the photographic component of all events during the day, in order to ensure the highest quality photographic coverage. If the photographic component of any event is not given adequate time and attention, the Client acknowledges that high quality photographic coverage may not be possible.

exclusivity

The Client agrees that the Photographer is the official, exclusive photographer hired to photograph the wedding. Family, friends, and guests of the Client are permitted to take photographs if and only if they do not interfere with the Photographer’s duties. If, at the discretion of the Photographer, any interference with the Photographer’s services becomes insurmountable and irreconcilable, the Client agrees that the Photographer will be released from all obligations of this agreement, including photographic coverage of the wedding and the delivery of photographs, with no obligation of refund to the Client.

receipt of photos

The expected date that the Client will receive their photos will be the day after the final payment is received. The Client acknowledges that unforeseen circumstances such as film and editing processing times may affect the receipt date of the images. In the event that the Client does not deliver any one of the scheduled payments on time as outlined in their payment plan, the Photographer reserves the right to withhold all photographs until up to eight (8) weeks after all payments have been received in full, or until eight (8) weeks after the originally scheduled delivery date, whichever is later. The Photographer agrees to deliver a minimum of forty (40) photographs per hour of wedding coverage. The Client agrees that the Photographer holds no obligation to provide additional photos. The Client acknowledges that their wedding photography package will be sent to the address they specified in the wedding information form, and that they are responsible for any necessary arrangements in the event of a change of address.

photo discs

The Client accepts all responsibility for archiving and protecting the photographs provided to them. The Photographer is not responsible for the lifespan of any digital media provided, or for any future changes in digital technology or media readers that might result in an inability to access the photographs. It is the Client’s responsibility to ensure that digital files are copied to new media as required.

liability

In the event that essential equipment is stolen or damaged during the wedding, The Client agrees that the Photographer shall not be held responsible for any loss or omission of photographs. In the event that the Photographer is unable to provide photographic services for the wedding due to unforeseen circumstances beyond the Photographer’s reasonable control, a replacement photographer of equal skill will be arranged at no charge, at the discretion of the Photographer. The Client agrees that the Photographer shall not be liable for any personal injury, loss or damage to property occasioned by any act or omission.
